Монография посвящена исследованию вещно-правовых способов защиты права собственности и иных вещных прав. В книге проведен всесторонний анализ вещных исков; рассматриваются понятие и признаки вещных исков; охарактеризована структура вещных исков; предложена самостоятельная система вещно-правовых требований. Значительная часть работы посвящена рассмотрению отдельных вещно-правовых способов защиты. Большое внимание уделяется проблеме конкуренции вещных исков, рассмотрено соотношение вещно-правовых и обязательственно-правовых исков. В работе приведена и проанализирована арбитражная и судебная практика, предлагаются решения актуальных проблем, связанных с защитой вещных прав.

The monograph is devoted to research of proprietary ways of protection of the property right and other real rights. In the book the comprehensive analysis of real claims is carried out; the concept and signs of real claims are considered; the structure of real claims is characterized; the independent system of proprietary requirements is offered. The considerable part of work is devoted to consideration of separate proprietary ways of protection. Much attention is paid to a problem of the competition of real claims, the ratio of proprietary and obligations and legal claims is considered. In work it is provided and analysed arbitration and jurisprudence, solutions of the actual problems connected with protection of the real rights are proposed.

The monograph is intended for teachers, graduate students, magistrates and students of legal higher education institutions and faculties, and also scientists dealing with problems of civil law and the practicing lawyers.
Tikhon Podshivalov, PhD in Law, Associate Professor South Ural State University (Chelyabinsk, Russia). He graduated magna cum laude from Law faculty of the South Ural State University with a degree in jurisprudence.
Since 2008th he is a lecturer of Civil Law and Process department. He holds such courses as «Russian Civil Law», «Private Inteational Law», and «Theory of Property Rights».
In 2011th he defended his thesis on the topic of «Negatory action» in the Dissertation Council of the Saratov State Academy of Law, specialty
12.00.03. The basic idea of the dissertation research was to justify the fact that negatory action is not a universal way to protect property rights.
Since 2012 he has been a member of the Russian Association of Inteational Law. In 2014 the Ministry of Education and Science of the Russian Federation awarded him the rank of associate professor in the specialty «Civil law; Business law; Family law; Private inteational law».
Research interests - the problems of property rights protection, objects of civil rights and immovable property, the implementation of the principle of good faith (precontractual liability, the prohibition of circumvention of the law, estoppel, the doctrine of lifting the corporate veil, the abuse of civil rights), private inteational law. The main focus of the research is to elaborate a system of real action under the conditions of reforming the civil legislation of the Russian Federation and the changes in judicial practice, including with respect to immovable property.
Novosyolova Anna, PhD in Law, associate professor of civil disciplines Northwest (St. Petersburg) of branch of the Russian legal academy of the Ministry of Justice of the Russian Federation.
Author more than two tens scientific and educational and methodical works on civil law, inteational private law and land right. Area of scientific interests – problems of the real rights, the loan and credit relations, implementation and protection of the civil rights, legal bases of regulation of the land and contractual relations, questions of the state registration of the rights for real estate objects, the inteational private law.
Has considerable experience practical, scientific and study in economic and in educational spheres.
