preservation of federalism—could not be obtained by a suitably engineered unicam-
eral legislature or through vigorous judicial review.
One might respond to our analysis by suggesting that while the benefits of bicam-
eralism are low, so are the costs. This may well be the case for the largely symbolic
upper chambers of advanced democracies. However, the costs could be quite large in
developing democracies if a misplaced faith in the virtues of bicameralism precludes
more effective protections for political minorities.
