Selected UK legislation relevant to

environmental protection and

occupational health and safety in

relation to chemicals

The general principles outlined in this work for the identification and control of hazardous chemicals are independent

of legislation. However, regulatory obligations forcing compliance with national and/or local requirements should be

consulted. Space prevents encyclopaedic coverage but the following brief selection of relevant UK legislation serves to

illustrate the scope. It is supplemented by the lists of legislation in the Bibliography.

General health and safety

The minimum standards for health and safety are those outlined in numerous pieces of statutory legislation. These

include the:

All of these contain requirements of relevance to work with hazardous chemicals.

Selected legislation relevant to the control of hazardous chemicals

The following legislation is of direct relevance.

Asbestos (Prohibitions) Regulations 1992

Cover the prohibition of the importation, supply or new use of amphibole asbestos or products containing it. Also

prohibit the supply and use of a range of products containing chrysotile asbestos.

Carriage of Dangerous Goods by Rail Regulations 1996

The scope includes carriage of dangerous substances by wagons, large containers, small containers and tanks. Cover

the documentation requirements, the mode of transport, the information needs, loading/unloading, security, safety

and emergency requirements with special provisions for explosives. The carriage of temperature-controlled substances

is prohibited.

Carriage of Dangerous Goods by Road Regulations 1996

Cover the carriage of dangerous goods by road in bulk, in tanks and in containers. The requirements for documentation,

information, loading/unloading, and emergencies and parking are included.

Carriage of Dangerous Goods by Road (Driver Training) Regulations 1996

Cover the instruction, training and certification of drivers of motor vehicles engaged in the carriage of dangerous goods.

Carriage of Dangerous Goods (Classifications, Packaging and Labelling) and Use of Transportable Pressure

Receptacles Regulations 1996

Cover the classification, packaging and labelling of dangerous goods. The requirements for design, manufacture,

modification, repair, approval, certification and marking of transportable pressure containers are included. The role

of ‘approved persons’ to comply with the regulations is explained.

Carriage of Explosives by Road Regulations 1996

Prohibit the carriage of certain explosives. Concerned with the carriage of explosives in vehicles used to carry

passengers and carriage in bulk. The suitability of both vehicle and container, vehicle approval, types of vehicles,

and quantity limits for loads are regulated. Cover the requirements for information, and safety and security during

transit. This includes route of carriage, parking, load integrity, equipment, precautions against fire and explosion,

and the requirements in the event of accidents and emergencies.

Chemicals (Hazard Information and Packaging for Supply) Regulations 1994

Regulate the classification, provision of safety data sheets, labelling and packaging of substances and preparations

dangerous for supply. There are specific exceptions, e.g. medicines, pesticides, wastes, radioactive substances or

preparations.

Confined Spaces Regulations 1997

Requirements for work in confined spaces, including avoidance of entry if reasonably practicable, provision of a

safe system of work and establishment of adequate emergency arrangements.

Control of Asbestos at Work Regulations 1987 (amended 1992 and 1999)

Requirements for the control of asbestos exposures at work. Exposure is to be prevented or, if this is not reasonably

practicable, reduced to the lowest level reasonably practicable by measures other than the use of respiratory

protective equipment.

Control of Explosives Regulations 1991

Concerned mainly with the security of explosives and restricted substances. Applicable to the acquisition, keeping,

handling and control of explosives, e.g. blasting explosives, detonators, fuses, ammunitions, propellants, pyrotechnics

and fireworks.

Control of Lead at Work Regulations 1980

Requirements for protecting the health of workers exposed to lead including lead alloys, lead compounds and lead

containing substances. A risk assessment is necessary.

Provision of adequate information, instruction and training; control against exposures by measures other than the

use of personal protective equipment; provision of adequate washing facilities; prohibition of eating, drinking and

smoking in contaminated areas; and health surveillance are covered.

Control of Major Accident Hazard Regulations 1999

Regulate the design and operation of defined major hazard installations. All necessary measures are required to

prevent and limit the consequences of major accidents. Operators of upper-tier sites must produce a detailed Safety

Report; those of lower-tier sites must prepare a Major Accident Prevention Policy.

Control of Pesticides Regulations 1986

Prohibit the advertisement, supply, storage and use of pesticides unless they have been approved. ‘Pesticides’

includes herbicides, fungicides, wood preservatives, plant growth hormones, soil sterilants, bird or animal repellants,

masonry biocides and anti-foul boat paints. Conditions are applied to supply, storage and use. Competence training

and certification is required for commercial use in agriculture generally.

Control of Substances Hazardous to Health Regulations 1999

Cover the control of substances classified as very toxic, toxic, harmful, corrosive, sensitizing or irritant under the

Chemicals (Hazard Information and Packaging for Supply) Regulations 1994 (as amended) and to substances which

have MELs or OESs. Also other substances that have chronic or delayed effects and biological agents. Special

provisions are included for carcinogens.

Dangerous Substances in Harbour Areas Regulations 1987

Requirements for prior notice of arrival of dangerous substances into ports.

Dangerous Substances (Notification and Marking of Sites) Regulations 1990

Requirements for notification and appropriate marking of any site containing large quantities of dangerous substances.

Principally aimed at the safety of fire officers attending incidents.

Fire Precaution Act 1971

Provides for the control of fire safety in all designated occupied premises, by ensuring that adequate general fire

precautions are taken and appropriate means of escape and related precautions are present. Specifies the requirements

for a fire certificate for various premises.

Fire Precautions (Workplace) Regulations 1997, as amended

Apply to all workplaces, unless specifically excepted, and require a fire risk assessment; where necessary, appropriate

fire-fighting equipment with detectors and alarms; measures for fire-fighting; emergency routes and exits; maintenance

of equipment provided.

Gas Safety (Installation and Use) Regulations 1994

Requirements for any employer of, or self-employed, persons to be members of the Council for Registered Gas

Installers (CORGI). Individual gas fitters must possess certificates of competence.

Health and Safety (First-Aid) Regulations 1981

Requirements for every employer to provide equipment and facilities which are adequate and appropriate in the

circumstances for administering first aid to employees. Adequate numbers of suitable persons are needed to administer

first aid.

Health and Safety (Safety Signs and Signals) Regulations 1996

Cover means of communicating health and safety information in all workplaces. Include illuminated signs, alarms,

verbal communication, fire safety signs, marking of pipework, etc.

Highly Flammable Liquids and Liquefied Petroleum Gases Regulations 1972

Cover the storage, handling and use of highly flammable liquids, viz. liquids with a flashpoint <32°C and which

support combustion when tested in the prescribed ways. Also cover the manner of storage and the marking of

storage accommodation for LPG, viz. commercial propane, commercial butane and any mixture of the two.

Ionizing Radiations Regulations 1999

Cover all work with ionizing radiations, including exposure to naturally occurring radon gas. Special arrangements

are required to protect outside workers, e.g. contractors. Specified practices need authorization and the regulatory

authority must receive prior notification of specified work. Govern risk assessment, exposure, personal dosimetry,

engineering controls, personal protective equipment, contingency plans, management controls, designated areas,

control of radioactive substances.

Notification of New Substances Regulations 1993

Requirements for the notification of new substances, irrespective of their potential for harm, before they can be

placed on the market. Aim to ensure that a chemical placed on the market can be validly marketed in any EU state

without duplicating authorization.

Packaging, Labelling and Carriage of Radioactive Material by Rail Regulations 1996

Govern the need for documentation, design for special forms of radioactive material, approval, packaging, loading/

unloading, and shipment including the requirement for prior inspections. Also cover security measures and procedures

in the event of emergencies plus obligations on provision of information, emission evaluation and certification.

Personal Protective Equipment at Work Regulations 1992

Cover all aspects of the provision, maintenance and use of personal protective equipment at work and in other

circumstances.

Petroleum Consolidation Act 1928

Regulates the use, transport or storage of petroleum spirit and – as extended by other legislation – mixtures, e.g.

adhesives, thinners or lacquers containing petroleum, and non-petroleum based solvents with a flash point <73°F.

Provision and Use of Work Equipment Regulations 1998

Govern the provision and use of all work equipment (i.e. any machinery, appliance, apparatus, tool or installation

for use at work) including mobile and lifting equipment. Cover general requirements relating to the selection,

inspection and maintenance of equipment, protection against specific risks (e.g. dangerous parts of machinery, high

or very low temperature, equipment failure scenarios, discharge of any article or substance from equipment) and the

provision of instruction, information and training.

Radioactive Substance Act 1993

Governs the keeping and use of radioactive substances and the storage and disposal of radioactive waste.

Reporting of Injuries, Diseases and Dangerous Occurrences Regulations (RIDDOR) 1995

Requirements for the reporting of certain categories of injury and disease sustained at work, and specific dangerous

occurrences or gas incidents, to the enforcing authority.

Social Security (Industrial Injuries) (Prescribed Diseases) Regulations 1985

List the diseases prescribed for the payment of disablement benefit, if related to specific occupations. Conditions

due to chemical agents, e.g. poisoning by any of a range of chemicals and certain carcinomas, and miscellaneous

conditions, e.g. pneumoconiosis, asthma, diffuse mesothelioma, non-infective dermatitis are included.

Transport of Dangerous Goods (Safety Advisers) Regulations 1999

Requirements for provision of adequate information, time and other resources to safety advisers to fulfil their

functions. These include monitoring compliance with rules relating to transportation of dangerous goods; advising

on transportation; implementing emergency procedures; investigating serious accidents, incidents or infringements

and implementing measures to avoid a recurrence, etc.

Workplace (Health, Safety and Welfare Regulations) 1992

Aim to protect the health and safety of everyone in the workplace and ensure that adequate welfare facilities are

provided. Covers e.g. general ventilation, temperature in indoor workplaces, lighting, cleanliness, space requirements,

condition of floors and traffic routes, measures against falls/falling objects, washing facilities.

Environmental protection legislation

Clean Air Act 1993

Sets out ancillary controls related to air pollution control including regulation of smoke, grit, dust and fume

emissions from non-prescribed industrial processes; provision of a lower level of control over some smaller combustion

plants not covered by IPC or LAAPC; prohibition of the emission of ‘dark smoke’ from any chimney or industrial

premises.

Environment Act 1995

Created the Environment Agency (EA) and the SEA for Scotland. Contains detailed provisions for dealing with a

range of environmental issues including air quality; contaminated land; reinforcing the ‘polluter pays’ principle;

water quality, with the EA empowered to require action to prevent water pollution and to require polluters to clean

up after any pollution episode.

Environmental Protection (Duty of Care) Regulations 1991

Establish a system of transfer notes and record keeping of waste transfers to assist ‘waste holders’ comply with their

duty of care under Section 34 of the EPA 1990.

They must take all reasonable steps to ensure waste is collected, treated, transported and disposed of by licensed

operators.

Environmental Protection Act 1990

Covers eight aspects of the control of pollution and protection of the environment; Integrated Pollution Control

(IPC) and Air Pollution Control identifying industrial processes scheduled for control by the Environment Agency

or local authorities (LAS); Waste on Land, imposing a duty of care on anyone who imports, carries, keeps, treats

or disposes of waste on land; Statutory Nuisances and Clean Air; Litter; amendments to the Radioactive Substances

Act 1960; Genetically Modified Organisms, dealing with the prevention, or minimization of any damage to the

environment from the escape or release of GMOs; Nature Conservation; miscellaneous provisions.

Pollution Prevention and Control Act 1999

Implements a new system of pollution control, Integrated Pollution Prevention and Control (IPPC), which will

eventually replace IPC and LAPC under the Environmental Protection Act 1990.

Waste Management Licensing Regulations 1994 (as amended)

Implement in detail the regulatory system for a waste management licence under EPA 1990.

Water Industry Act 1991

Sets out the powers and duties of Statutory Undertakers (SUs) with regard to water supply, the provision of sewerage

services and consent requirements for the receipt of trade effluents.

Water Resources Act 1991

Sets out the duties and powers of the NRA, part of the Environment Agency, in relation to water resources

management, abstraction and impounding, control of pollution of water resources, flood defence.
